4. Legal Services — Scope and Engagement

Legal services are provided only once a formal engagement has been established through a signed engagement agreement. The scope, fees, timelines, and responsibilities for each matter will be set out in that agreement.

An initial consultation or enquiry does not constitute commencement of legal representation. Vicarum reserves the right to decline any matter at its discretion, including those where a conflict of interest exists or where the matter falls outside our areas of practice.

5. Service-Specific Terms

Shariah Law Consultation: Advice is provided in the context of Malaysian Shariah law and the dual court system. The scope of advice is limited to the facts disclosed. Clients are responsible for providing accurate and complete information.

Notarial Services: Authentication of documents is performed in accordance with the requirements communicated by the client. Vicarum is not responsible for the acceptance or rejection of notarized documents by foreign authorities, institutions, or courts.

Construction Law Advisory: Advice is based on the documentation provided. Adjudication submissions are prepared to the best of our ability within the timeframe available. The outcome of any adjudication or dispute resolution process is not within our control.

6. Fees and Payment

Fees are set out in the engagement agreement and are payable in Malaysian Ringgit (MYR). Disbursements and third-party costs are in addition to professional fees and will be communicated in advance where possible.

Payment terms will be specified in the engagement agreement. Invoices unpaid beyond the agreed period may result in suspension of services.

Refunds, where applicable, are subject to the terms of the relevant engagement agreement. No refund is payable for time spent by the practice prior to withdrawal of instructions.

7. Intellectual Property

All content on this website — including text, layout, and design — is the property of Vicarum and is protected under applicable Malaysian law. You are granted a limited, non-exclusive licence to access and view this content for personal, non-commercial purposes.

You may not reproduce, redistribute, or republish any part of this website without our written consent.

9. Limitation of Liability

To the extent permitted by Malaysian law, Vicarum's liability for any claim arising out of the use of this website (excluding claims arising from our negligence in the provision of legal services) is limited to the greater of: (a) MYR 500, or (b) fees paid in the three months preceding the relevant event.

We are not liable for indirect, consequential, or incidental damages arising from use of or inability to use this website.

10. Termination of Engagement

Either party may terminate a legal engagement in accordance with the terms of the relevant engagement agreement. Termination does not affect rights or obligations that have accrued prior to termination.

Upon termination, outstanding fees for work completed to that date remain payable. Original documents will be returned to the client; copies may be retained in accordance with professional obligations.

11. Dispute Resolution

In the event of any dispute arising from these Terms or from an engagement, the parties agree to first attempt resolution through direct discussion. If that is unsuccessful, the dispute will be subject to the exclusive jurisdiction of the courts of Malaysia, applying Malaysian law.

Links to external websites are provided for convenience only. Vicarum does not endorse, control, or accept responsibility for the content of any linked site. Access to third-party websites is at your own risk.

13. Changes to These Terms

These Terms may be updated from time to time. The revised version will be published on this page with an updated effective date. Continued use of the website after changes are published constitutes acceptance of the revised Terms.
