Shariah Estate Advisory

Navigating Faraid Distribution in a Mixed-Asset Estate

Challenge

A family approached Vicarum following the passing of their patriarch. The estate included both property and financial assets, and the beneficiaries were uncertain how faraid applied to each category under Malaysian Shariah law.

Approach

The team categorised the assets, identified the applicable faraid shares for each beneficiary, and guided the family through the Shariah court process. Documentation was prepared and submitted on the family's behalf.

Outcome

The estate was distributed according to faraid within three months of the initial consultation. All beneficiaries received their entitlements and the family avoided a dispute that had been developing before legal advice was sought.

Payment Recovery Through CIPAA Adjudication

Challenge

A subcontractor was owed approximately MYR 180,000 by a main contractor following the completion of electrical works on a residential development in Negeri Sembilan. The main contractor had withheld payment citing alleged defects.

Approach

Vicarum reviewed the subcontract and the alleged defect claims. An adjudication submission under CIPAA 2012 was prepared, supported by a review of the relevant project records and a response to the main contractor's position.

Outcome

The adjudicator found in the subcontractor's favour. The main contractor released the withheld sum within the period set by the adjudication decision. The matter was resolved without court proceedings.

Cross-Border Power of Attorney for Overseas Property Transfer

Challenge

A Malaysian client needed to authorise a representative in Australia to manage and transfer property on his behalf. The Australian solicitor required a specific form of power of attorney, notarized and apostilled under Malaysian authority.

Approach

Vicarum coordinated with the client and the Australian solicitor to confirm the required form. The document was drafted, reviewed for compliance with Australian requirements, and attested by the firm's notary public.

Outcome

The power of attorney was accepted by the Australian solicitor and the property transfer proceeded without issue. The entire notarial engagement from initial instruction to delivery of the authenticated document took four working days.
